In China, there are two drunk-driving classifications. When a driver has a blood alcohol concentration (BAC) over 20mg/100ml (0.02%) but under 80mg/100ml (0.08%), they are classified as driving after drinking (DAD, 酒驾). Drivers with a BAC of 80mg/100ml (0.08%) or above are classified as driving while intoxicated (DWI, 醉驾).
Punishments for drunk driving vary according to whether the driver is classified as DAD or DWI, whether it’s a first-time or repeat offense, and whether the driver is driving a private or commercial vehicle.
Punishments for DAD (酒驾)
·First-time offense: 12 penalty points added from your driving license, which will be suspended and confiscated for 6 months, and a 1000-2000 yuan fine.
·Subsequent offenses: Up to 10 days administrative detention, a 1,000-2000 yuan fine, and license revoked.
·While driving a commercial vehicle (regardless the number of offenses): 15 days administrative detention, a 5,000 yuan fine, and license revoked for 5 years.
Punishments for DWI (醉驾)
·While driving a private vehicle: Detained by police until sober, criminal prosecution, and license revoked for 5 years.
·While driving a commercial vehicle: Detained by police until sober, criminal prosecution, license revoked for 10 years, and banned from driving commercial vehicles in the future.
·If your driving causes a serious traffic accident: Criminal prosecution if criminal liability is found and permanent revocation of license.
